October 6, 2015 — An Ohio man who was paralyzed in a car accident has been awarded $16 million by a jury that blamed his injuries on a defective Goodyear tire, according to the Herald Palladium.
The plaintiff, Harry Patel, was injured while driving 70 mph on U.S. 31 freeway in Berrien County, Ohio in July 2012. When a tire blew out, his Nissan Pathfinder flipped into a ditch and he became a quadriplegic.
Lawyers for Goodyear Tire & Rubber said Patel likely hit something in the road, causing tread separation.
After a two-week trial, the jury found Goodyear responsible for making a defective tire. According to Patel’s son: “We knew from day one we wanted to see this through.”
This is the second time the case has gone to trial. Another trial last year ended in a mistrial when the jury could not reach a decision.
The jury awarded Patel $1.3 million for past medical expenses. He was also awarded $7 million for future costs of his 24-hour medical care for the rest of his life, $3 million for past pain and suffering, and $250,000 for future pain and suffering every year for the rest of his life.
The decision could be reduced due to product liability laws in Michigan. Goodyear is likely appeal to the Michigan Court of Appeals.
