Class Action Filed Over Genki Sushi Hep A Outbreak

Lawsuits filed for hepatitis A victims who ate at Genki Sushi.

August 24, 2016 — A class action lawsuit has been filed for hundreds of people who developed hepatitis A after eating scallops at Genki Sushi restaurants in Hawaii.

A law firm in Honolulu filed the class action yesterday in the 1st Circuit Court. Last week, the Hawaii Department of Health blamed the outbreak on frozen scallops imported from the Philippines.

The lawsuit was filed on behalf of everyone who ate or drank at Genki Sushi restaurants since April 2016 and required a hepatitis A vaccine or immune globulin (IG) shot.

Lawyers say all food and drink sold at Genki Sushi during the exposure period were unsafe as a result of the contaminated scallops, which potentially exposed thousands of people to hepatitis A.

They say over 10,000 people may need a vaccination. The outbreak infected over 200 people in Hawaii and a few cases have been reported on the mainland as well.

The class action does not represent people who were actually infected with hepatitis A. Those cases will likely be handled individually because the injuries vary widely — some victims had only a few days of illness, while others were hospitalized or had symptoms for months.

Genki Sushi has been closed since last week. Health officials told KHON2 the restaurants has already completed most of the cleaning requirements needed to reopen. The workers are also undergoing mandatory testing for hepatitis A.
