Tropical Smoothie Class Action Lawsuits

On August 25, a class action (PDF) was filed by Laura L. Pyka on behalf of everyone who needed a vaccine after eating at Tropical Smoothie Café in July and August 2016. The lawsuit was filed in the Circuit Court for the City of Richmond, Virginia.

Individual lawsuits have also been filed by people who were actually diagnosed with hepatitis A. The first was filed by a man from Virginia who was hospitalized for 4 days. Hepatitis A Outbreak

As of September 16, 2016, health officials have confirmed a total of 119 illnesses in 8 states. The case count is Arkansas (1), Maryland (12), New York (3), North Carolina (1), Oregon (1), Virginia (94), West Virginia (6), and Wisconsin (1). At least 47 ill people have been hospitalized. No deaths have been reported

Strawberries Linked to Hepatitis A Outbreak

The Centers for Disease Control (CDC) believes frozen strawberries imported from Egypt caused the outbreak of hepatitis A. The strain of hepatitis A is the same one that caused two outbreaks in Europe in 2013 in which over 100 people were sickened by strawberries from Egypt and Morocco.

What is Hepatitis A?

Hepatitis A is a contagious virus that causes liver inflammation. It spreads by the “fecal-to-oral” route of transmission and outbreaks occur due to contaminated food or water.

The symptoms can begin anywhere from 15-50 days after exposure, and persist for up to 6 months. The symptoms include:

• Fever
• Jaundice (yellowing of skin and eyes)
• Muscle aches
• Headache
• Anorexia (loss of appetite)
• Abdominal discomfort
• Fatigue
