February 25, 2014 — Law 360 reports that plaintiffs in a class action lawsuit involving the Flushmate System, a high-pressurized toilet that can sometimes explode, have been offered an $18 million cash settlement.
The $18 million settlement could increase if additional funds are needed to resolve personal injury claims.
The proposed settlement would end negotiations that have lasted nine months. The defendants (Flushmate, Sloan Valve Co., and American Standard) are accused of misleading customers about defects in the pressurized flushing system, marketing it as “trouble free” despite knowing that it could potentially explode.
Flushmate and the Consumer Products Safety Commission (CPSC) issued two recalls, one in January 2014 for about 360,000 units and another in June 2012 for 2.3 million units. Click here to read more.
According to the recall notification, Flushmate has received over 300 reports of the toilet bursting, resulting in property damage and 14 impact or laceration injuries:
“The system can burst at or near the vessel weld seam releasing stored pressure. This pressure can lift the tank lid and shatter the tank, posing impact or laceration hazards to consumers and property damage.”
