July 3, 2023 — The global real estate developer Greystar has been hit with another wrongful death lawsuit involving a weather-related construction site accident in Texas.
The wrongful death lawsuit was filed on behalf of Michael Delgado, a 29-year-old man who was riding his bicycle near the UT Campus when he was hit and killed by debris that flew off a construction site.
The construction site was a high-rise apartment complex that was being developed by Greystar.
The lawsuit accuses Greystar of ignoring the “extreme risk” posed by the weather conditions, including high wind and weather advisories.
Greystar was also accused of failing to properly secure materials at the jobsite, failing to have proper barriers around the jobsite, and failing to follow safety regulations to protect against falling debris.
The lawsuit was filed less than two months after a jury in Texas awarded $860 million to the family of a Kiersten Smith, a 29-year-old woman who died in a similar accident in 2019, when a construction crane fell onto her apartment building in Dallas during a severe storm with high winds.
The construction crane was being used to build another apartment building that Greystar was developing in Texas.
