July 12, 2013 — Monster Beverage is facing yet another energy drink lawsuit from the family of Alex Morris, a 19-year old who died after going into cardiac arrest during on July 1, 2012.
The wrongful death lawsuit alleges that his death was caused by habitually drinking Monster Energy Drinks. According to the complaint, Morris drink two cans of Monster’s energy drink every day for three years before his death.
The complaint was filed in Alameda County, California, by Paula Morris, the mother of Alex Morris. She alleges that Monster is responsible for her son’s death because they failed to warn about the dangers of consuming the beverage.
Monster is also facing a wrongful death lawsuit filed on behalf of 14 year-old Anais Fournier, of Maryland, who died after consuming two 24-ounce cans of Monster. Although the lawsuit alleges that she died of “caffeine toxicity,” Monster alleges that her death was caused by pre-existing heart problems.
The lawsuits come at a time of increasing concern about the safety of energy drinks. The American Academy of Pediatrics has warned that energy drinks should not be consumed by children or adolescents because of the potential health risks. The U.S. Food and Drug Administration (FDA) also received 5 reports of death linked to Monster energy drinks between April 2009 and May 2012, according to this report (PDF).
Many energy drinks contain large amounts of caffeine, amino acids, vitamins, artificial flavorings, and undisclosed substances. Because the products are regulated as “dietary supplements” and not food or beverages, companies do not need to list the ingredients. The FDA is also investigating 33 hospitalizations and 13 deaths linked to 5-Hour Energy.
